Other Responsibility
At ServerMO, we place a strong emphasis on the actions our users take, whether they
are lawful or unlawful, when they have the potential to harm our subscribers,
operations, reputation, goodwill, or customer relationships. While the primary
responsibility for avoiding these harmful activities rests with the subscriber, we
must ensure the integrity of our services.
We do not engage in routine monitoring of our subscribers' communications to verify
their compliance with ServerMO's policies or applicable laws. However, if any
detrimental behaviors are discovered, we may take action to stop them. This can
include actions such as removing specific content, suspending websites, deploying
screening software to block offensive transmissions, denying Internet access, or any
other action that we deem suitable.
We are aware that many of our customers also run their own Internet service
businesses. Information reaching ServerMO's facilities through these subscribers may
originate from their customers or other third parties. ServerMO does not mandate
that subscribers who offer Internet services should monitor or censor transmissions
or websites created by their customers.
ServerMO retains the right to take direct action against the customer of our
subscribers. In situations where a customer's activities have an impact on other
subscribers of the same entity, we may also take action against the subscriber
directly. Additionally, we anticipate our subscribers who provide Internet services
to assist us in taking any remedial or preventative measures we deem essential.
Failure to cooperate with these measures would be considered a violation of
ServerMO's policies.
We want to emphasize that we do not intentionally monitor private electronic mail
messages sent or received by our subscribers unless required by law, government
authorities, or when there are concerns about public safety. We may, however,
electronically monitor our services to ensure they are functioning correctly.
Furthermore, we may disclose information, including information regarding a
subscriber, a transmission made using our network, or a website to comply with a
court order, subpoena, summons, discovery request, warrant, statute, regulation, or
governmental request. In some cases, we may be prohibited by law from providing
notice to the subscriber about such disclosures. Lastly, we may disclose subscriber
information or information transmitted over our network when it is necessary to
protect ServerMO and others from harm, or when such disclosure is essential for the
proper functioning of our systems. It's crucial to note that we never sell
information to other services or outside companies. We expect that our subscribers
who provide Internet services to others will fully adhere to all applicable laws
regarding online communications privacy. Failure to comply with these laws will be
considered a violation of ServerMO's policy. Finally, ServerMO wants to be clear
that by agreeing to the Service Agreement, subscribers are holding ServerMO harmless
from any losses incurred by ServerMO as a result of violations of the Service
Agreement, the law, or ServerMO policy, as well as from any claims made by third
parties. This means that if ServerMO is sued due to the actions of a subscriber or a
customer of a subscriber, the subscriber will be responsible for any damages awarded
against ServerMO, as well as associated costs and reasonable attorney's fees. We
believe that this Acceptable Use Policy (AUP) clarifies for all Internet users,
including ServerMO and its subscribers, what it means to be a responsible member of
the online community.Send any grievances you may have regarding a subscriber's
